സർക്കാർ ജീവനക്കാരുടെ പേരിലുള്ള എല്ലാ കോ-ഓപ്പറേറ്റീവ് റിക്കവറികളും
കോ-ഓപ്പറേറ്റിവ് റിക്കവറി സംബന്ധമായ ചില സർക്കാർ ഉത്തരവുകളുടെ സംക്ഷിപ്തം
സർക്കാർ ജീവനക്കാരുടെ പേരിലുള്ള എല്ലാ കോ-ഓപ്പറേറ്റീവ് റിക്കവറികളും നടത്താൻ അവരുടെ ശമ്പളം തികയാതെ വരുന്നുണ്ട്. ഇത്തരം അസാധാരണ സാഹചര്യത്തിൽ, പരമാവധി നടത്താവുന്ന റിക്കവറി ശമ്പളത്തിന്റെ 1/3 മാത്രമാണെന്ന കേരള ഫിനാൻഷ്യൽ കോഡ് ആർട്ടിക്കിൾ 62 ലെ നിബന്ധന പ്രായോഗികമാവുകയില്ല. ഇപ്രകാരം കടബാദ്ധ്യത ഉണ്ടാക്കുന്നത് കേരള സർക്കാർ ജീവനക്കാരുടെ പെരുമാറ്റ ചട്ടങ്ങളിലെ 51 മുതൽ 55 വരെയുള്ള ചട്ടങ്ങൾ പ്രകാരം സേവനത്തിൽ നിന്നും നീക്കം ചെയ്യുവാൻ കാരണമാകുന്നതാണ്. ആയതിനാൽ തിരിച്ചടയ്ക്കാനാകാത്ത വിധം കടബാദ്ധ്യത ഉണ്ടാകുന്ന തരത്തിൽ പാപ്പരാകുന്നതും കോ-ഓപ്പറേറ്റീവ് അറ്റാച്ചമെന്റ്, കോടതി അറ്റാച്ചമെന്റ് എന്നിവ വരുത്തുന്നതും എല്ലാ സർക്കാർ ജീവനക്കാരും ഒഴിവാക്കേണ്ടതാണ്. ഇതിന് വിരുദ്ധമായി പ്രവർത്തിക്കുന്നവർ കേരള സർക്കാർ ജീവനക്കാരുടെ പെരുമാറ്റ ചട്ടങ്ങളിലെ വ്യവസ്ഥകൾ പ്രകാരം സേവനത്തിൽ നിന്നും നീക്കം ചെയ്യപ്പെടുന്നതുമാണ്. (സർക്കുലർ നമ്പർ 10/98/ഫിൻ തീയതി 09.02.1998).
09.02.1998 തീയതിയിലെ സർക്കുലറിലെ നിർദ്ദേശങ്ങൾ പാലിക്കാതെ വളരെയധികം ജീവനക്കാർ ഇപ്പോഴും കോ-ഓപ്പറേറ്റീവ് ലോണുകളും കടം വാങ്ങാനുള്ള സൌകര്യവും ഉപയോഗിക്കുകയും കോ-ഓപ്പറേറ്റീവ് സൊസൈറ്റികൾ, ധനകാര്യ സ്ഥാപനങ്ങൾ, കെ.എസ്.എഫ്.ഇ തുടങ്ങിയ സ്ഥാപനങ്ങളിൽ തിരിച്ചടയ്ക്കാനുള്ള കഴിവിനേക്കാൾ അധികരിക്കുന്ന തരത്തിൽ കട ബാദ്ധ്യത വരുത്തുകയും ചെയ്യുന്നുണ്ട്. കോ-ഓപ്പറേറ്റീവ് സൊസൈറ്റികൾ പ്രവർത്തിക്കുന്നത് കോ-ഓപ്പറേറ്റീവ് സൊസൈറ്റീസ് ആക്ട് അനുസരിച്ചായതിനാൽ അത്തരം സൊസൈറ്റികളിലും ബാങ്കുകളിലും സർക്കാർ ജീവനക്കാർ വരുത്തുന്ന കുടിശ്ശിക അവരുടെ ശമ്പളത്തിൽ നിന്നും ഈടാക്കി നൽകേണ്ട നിയമപരമായ ബാദ്ധ്യത സർക്കാരിനുണ്ട്. മാത്രമല്ല ഇത്തരത്തിൽ തൊഴിലുടമ റിക്കവറി നടത്തുന്നതിലേക്കായി മെംമ്പർമാർ സൊസൈറ്റിക്ക് സമ്മതപത്രം നൽകണമെന്ന വ്യവസ്ഥയും ഈ ആക്ടിലുണ്ട്. അതിനാൽ കുടിശ്ശിക വരുത്തുന്നപക്ഷം ശമ്പളത്തിൽ നിന്ന് റിക്കവറി നടത്താമെന്ന സത്യവാങ്മൂലം നൽകുന്നതിന് മുമ്പ് ഓരോ കേസിലും ജീവനക്കാരന്റെ തിരിച്ചടയ്ക്കാനുള്ള കഴിവ് ഉറപ്പ് വരുത്തേണ്ടതാണ്. അതിനാൽ ഒരു സർക്കാർ ജീവനക്കാരന്റെ ലോൺ തുകയുടെ തിരിച്ചടയ്ക്കേണ്ട ആകെ പ്രതിമാസത്തുക അയാൾ പ്രതിമാസം കൈയ്യിൽ വാങ്ങുന്ന ശമ്പളത്തിന്റെ പകുതിയിൽ അധികരിക്കുന്നില്ല എന്ന്, സത്യവാങ്മൂലം നൽകുന്നതിന് മുമ്പ് എല്ലാ വകുപ്പ് തലവന്മാരും ശമ്പളം നൽകുന്ന ഓഫീസർമാരും ഉറപ്പ് വരുത്തേണ്ടതാണ്. (സർക്കുലർ നമ്പർ 86/2007/ഫിൻ തീയതി 11.12.2007).
സർക്കാർ ജീവനക്കാർ പാപ്പരാവുകയോ അല്ലെങ്കിൽ സ്ഥിരമായി കടക്കാരാവുകയോ (Insolvancy and Habitual indebtness) ചെയ്യുന്നത് കൃത്യമായ മാനദണ്ഡങ്ങൾ പാലിക്കാതെ ശമ്പള സർട്ടിഫിക്കറ്റുകൾ നൽകുന്നത് മൂലമാണ്. അതിനാൽ ശമ്പള സർട്ടിഫിക്കറ്റും ബാധ്യത പത്രവും നൽകുമ്പോൾ ഡി.ഡി.ഒ മാർ ചുവടെ ചേർക്കുന്ന മാർഗ്ഗനിർദ്ദേശങ്ങൾ കർശനമായി പാലിക്കേണ്ടതാണ്. (i) ഒരാളുടെ മൊത്തം ശമ്പളത്തിൽ നിന്നും സഹകരണ/ധനകാര്യ സ്ഥാപനങ്ങളിലെ ബാധ്യത ഇനത്തിൽ റിക്കവറി ചെയ്യാവുന്ന പരമാവധി തുക ചുവടെ ചേർക്കുന്ന വിധം തിട്ടപ്പെടുത്താവുന്നതാണ്.
മൊത്ത ശമ്പളം = X
നിർബന്ധിത റിക്കവറി = Y (ചുവടെ ചേർക്കുന്ന ഇനങ്ങൾ മാത്രം)
i. വരുമാന നികുതിയും അധിക നികുതിയും
ii. ക്വാർട്ടേഴ്സിന്റെ വാടകയും അതിനോടനുബന്ധിച്ചുള്ള വെള്ളം, വൈദ്യുതി ചാർജ്ജുകൾ
iii. HBA, MCA തിരിച്ചടവുകൾ
iv. സർക്കാരിലേക്ക് തിട്ടപ്പെടുത്തിയ ബാധ്യതകൾ
v. GIS പ്രതിമാസ അടവുകൾ
vi. GPAIS അടവുകൾ
vii. ജനറൽ പ്രോവിഡന്റ് ഫണ്ട് അടിസ്ഥാന ശമ്പളത്തിന്റെ 6%
viii. NPS പ്രതിമാസ അടവുകൾ (അടിസ്ഥാന ശമ്പളത്തിന്റെ 10%)
ix. FBS അടവുകൾ
കിഴിവു കഴിഞ്ഞുള്ള ശമ്പളം = Z [ X-Y}
ഉപജീവന ബത്ത = 2/3 x Z
റിക്കവറി ചെയ്യാവുന്ന പരമാവധി തുക = 1/3 x Z
(ii) ഗസറ്റഡ് / നോൺ ഗസറ്റഡ് ജീവനക്കാർക്കും ശമ്പള സർട്ടിഫിക്കറ്റും ബാധ്യതാ രഹിത പത്രവും നൽകേണ്ടത് ഡി.ഡി.ഓ- മാർ തന്നെയാണ്. ഡി.ഡി.ഒ മാരുടെ ശമ്പള സർട്ടിഫിക്കറ്റും ബാധ്യതാ രഹിത പത്രവും നൽകേണ്ടത് പ്രസ്തുത ഉദ്യോഗസ്ഥരുടെ മേൽ ഉദ്യോഗസ്ഥരാണ്.
(iii) ഒരു ജീവനക്കാരൻ സ്വന്തം ശമ്പള സർട്ടിഫിക്കറ്റിന്റെ അടിസ്ഥാനത്തിൽ വായ്പ എടുക്കുന്ന സാഹചര്യത്തിൽ, ടിയാന്റെ അടിസ്ഥാന ശമ്പളത്തിന്റെ 75 ഇരട്ടി, പരമാവധി 3 കോടി, ഇവയിൽ ഏതാണോ കുറവ് എന്ന പരിധിക്ക് വിധേയമായി മാത്രമേ ഡി.ഡി.ഓ- മാർ ശമ്പള സർട്ടിഫിക്കറ്റും ബാധ്യതാ രഹിത പത്രവും നല്കാവു.
(iv) ഒരു ജീവനക്കാരൻ സ്വന്തം ശമ്പള സർട്ടിഫിക്കറ്റിന്റെ അടിസ്ഥാനത്തിൽ മറ്റൊരാൾക്ക് ജാമ്യം നിൽക്കുന്ന സാഹചര്യത്തിൽ, ടിയാന്റെ അടിസ്ഥാന ശമ്പളത്തിന്റെ 50 ഇരട്ടി, പരമാവധി 2 കോടി, ഇവയിൽ ഏതാണോ കുറവ് എന്ന പരിധിക്ക് വിധേയമായി മാത്രമേ ഡി.ഡി.ഓ- മാർ ശമ്പള സർട്ടിഫിക്കറ്റും ബാധ്യതാ രഹിത പത്രവും നല്കാവു.
ജാമ്യം നിൽക്കുന്ന സാഹചര്യത്തിൽ വായ്പ തുക പൂർണമായും കട ബാധ്യതയിൽ കാണിക്കേണ്ടതാണ്.
(v) ഒരു സർക്കാർ ഉദ്യോഗസ്ഥന്റെ സേവനകാലയളവിനുള്ളിൽ അടച്ചു തീർക്കാൻ കഴിയുന്ന വായ്പകളെടുക്കുന്നതിന് / ജാമ്യം നിൽക്കുന്നതിന് മാത്രമേ ഡി.ഡി.ഓ- മാർ ശമ്പള സർട്ടിഫിക്കറ്റും ബാധ്യതാ രഹിത പത്രവും നൽകേണ്ടതുള്ളു.
(vi) ഓരോ ജീവനക്കാരന്റേയും ശമ്പള സർട്ടിഫിക്കറ്റും ബാധ്യതാ രഹിത പത്രവും വിതരണം ചെയ്തതിന്റെ ഒരു രജിസ്റ്റർ ചുവടെ കാണുന്ന അനുബന്ധം -1 ൽ കാണുന്ന മാതൃകയിൽ ഡി.ഡി.ഓ- മാർ സൂക്ഷിക്കേണ്ടതാണ്.
(vii) ധനകാര്യ / സഹകരണ സ്ഥാപനങ്ങളിൽ നിന്നും റിക്കവറി നോട്ടീസ് കൈപ്പറ്റിയതിന്റെ തൊട്ടടുത്ത മാസം മുതൽ ഡി.ഡി.ഓ- മാർ റിക്കവറി ആരംഭിക്കേണ്ടതും ബന്ധപ്പെട്ട ധനകാര്യ സ്ഥാപനത്തിൽ നിന്നും നിർത്തിവയ്ക്കൽ നോട്ടീസ് (stop memo) ലഭിക്കുന്നത് വരെ തുടരേണ്ടതുമാണ്. ഡി.ഡി.ഓ- മാർക്കെതിരെ റിക്കവറി നോട്ടീസ് ലഭിക്കുന്ന സാഹചര്യത്തിൽ പ്രസ്തുത ഉദ്യോഗസ്ഥരുടെ മേൽ ഉദ്യോഗസ്ഥർ, പ്രസ്തുത റിക്കവറി നടത്തിയിട്ടുണ്ടെന്ന് ഉറപ്പ് വരുത്തേണ്ടതാണ്.
(viii) റിക്കവറി സംബന്ധിച്ച വിവരങ്ങൾ അനുബന്ധം 3 ൽ കാണുന്ന മാതൃകയിൽ ഉള്ള രജിസ്റ്ററിൽ സൂക്ഷിക്കേണ്ടതാണ്.
(ix) സഹകരണ സംഘങ്ങൾ ഉൾപ്പെടെയുള്ള എല്ലാ ധനകാര്യ സ്ഥാപനങ്ങൾക്കും ഡി.ഡി.ഓ- മാർ ഈ ഉത്തരവിന്റെ അനുബന്ധം-2ൽ കൊടുത്തിരിക്കുന്ന മാതൃകയിൽ ഉള്ള ശമ്പള സർട്ടിഫിക്കറ്റ് (Agreement for recovery ഉൾപെടെ) മാതൃമേ നൽകുവാൻ പാടുള്ളു.
(x) ഒരു ജീവനക്കാരന് സ്ഥലം മാറ്റം ലഭിക്കുമ്പോൾ ടിയാന്റെ ഡി.ഡി.ഓ- മാറുകയാണെങ്കിൽ, ടി ജീവനക്കാരന്റെ അവസാന ശമ്പള സർട്ടിഫിക്കറ്റ് (Last Pay Certificate LPC) പുതിയ ഓഫീസിലേക്ക് അയക്കുന്നതിനൊപ്പം ബന്ധപ്പെട്ട ഡി.ഡി.ഓ- ടി ജീവനക്കാരന്റെ ബാധ്യതകളെ പറ്റിയുള്ള രേഖകളും അയക്കേണ്ടതാണ്.
